1 – General and Legal

1.1 SAMUI MULTIMEDIA is the trade name of the company KSWC CO, LTD. situated at 2/36 Moo 1 Bophut – Koh Samui – Suratthani – Thailand 84320. DBD (Department of Business Development) Registry Number: 0845555002630.

1.2 The services provided by the company KSWC CO, LTD. aresubject to the following terms and conditions, which exists without limitation or change, when consulting the company KSWC CO., LTD.

1.3 The terms and conditions set out the terms of the contract between the customer and the company KSWC CO, LTD. and represent all of the obligations and rights of both parties.

1.4 The said conditions are subject to change at any time by the company KSWC CO., LTD .. The conditions in this case are those in force on the site at the date of the application service by the customer.

1.5 The customer states have full legal capacity to engage under these terms and conditions.

2 – Estimate

2.1 To receive a free quote, the customer must submit an application directly from the contact form on the website or e-mail: contact@samui-multimedia.com

2.2 The information contained in quotations is valid only from the date on it and for a period of seven days. Beyond these seven days, a new assessment must be made and a new quote will be realized.

2.3 The Client will provide all the elements needed to KSWC CO, LTD. to estimate the feasibility and time of the project. A timetable will be agreed on between the two parties.

3 – Terms and creation time

3.1 The customer agrees to provide all information necessary to meet the deadline for completion of the service agreed upon byKSWC CO, LTD.and to provide all necessary documentation to achieve this goal.
If the customer does not meet this commitment, the company KSWC CO, LTD.and it’s guardian, cannot be questioned and shall in no event be held liable for any delays in the delivery date of any project.

3.2 The case of a transfer of website: the transfer is carried out according to the procedures defined in the contract with the client’s consent. However, if the accommodation (and host) chosen by the customer does not meet current web standards, and the latest php and MySQL languages in progress, no compensation will be given to the customer by the company KSWC CO., LTD. in case of failure of the transfer. The same goes for size database transfer rate provided by said host, as well as technical problems due to server transfer.

3.3 Any additional services, whether under contract or already done but to be modified at the request of the customer will be charged at the expense of the client.
Any delay in delivery due to these requests may be attributed to the company KSWC CO., LTD. as well as it’s legal guardian.

3.4 KSWC CO., LTD. agrees to carry out tasks in the time indicated on the invoice or receipt of payment in which customer and KSWC CO, LTD. have agreed upon in accordance with the rules of art. Otherwise KSWC CO., LTD. undertakes to refund the customer requested tasks not respecting the invoice or receipt of payment in accordance with these terms and conditions.

4 – Payment

4.1 KSWC CO., LTD. Pricing applies to benefits based on that design complexity and the estimated time for its completion.

4.2 For projects that cost less than 40,000 THB, full payment is required before commencement. An invoice is copied in duplicate signed and kept by both parties.

4.3 For projects that cost more than 40,000 THB, a deposit of 50% of the total price is required with the order. A receipt of payment of the first payment and including the amount of the second payment to be provided to the end of the service is copied and kept, two copies signed by both parties. The remaining balance must be paid in full upon delivery of the service. Following this second payment, an invoice will be copied in duplicate signed and kept by both parties.

4.4 The legal representatives of KSWC CO., LTD. remain the sole owners of the service provided and may refuse delivery of it in part or in its entirety until full payment of the total amount is settled.

5 – Use on service delivery

5.1 The intellectual property of the project carried out and the work created under this contract is that of the company KSWC CO, LTD. and its legal representatives.

5.2 KSWC CO, LTD. may, however, in some cases, transfer to the client all rights to the work above: the right of reproduction, right of representation, marketing rights, right of use, possession, adaptation, translation, and more generally, all exploitation rights, as full payment of the service, at the express written request of the client, in writing and signed by both parties contract.

5.3 In addition, the customer authorizes the company KSWC CO, LTD. to use the result of achievements and disseminate the site samui-multimedia.com, excluding private information about the client itself.

6 – Disclaimer

6.1 The requested service is performed according to the instructions and information provided by the customer, and do not assume responsibility for the company KSWC CO., LTD in any way. Therefore, and to do so, the responsibility of the company KSWC CO., LTD. and its legal representatives on the service provided is completely cleared.

6.2 Similarly, any changes after the receipt of the benefit can not be attributed to the company KSWC CO., LTD .. The customer is under the responsibility of any modification, addition, deletion or alteration of the document, deliveryand service, as a whole, which could change the original meaning, the original content and original form.

7 – Data Protection

7.1 The company KSWC CO, LTD. agrees not to disclose any personal or private information concerning the customer, unless expressly agreed upon.

7.2 The information collected by the company KSW CO, LTD. in benefits and services are intended solely for internal use. No information is in any way passed on to third parties. The customer has a right to access, modify, rectify and delete personal data concerning him.

8 – Code of Intellectual Property

8.1 Any edition of writings, musical composition, drawing painting or any other printed or engraved work in whole or in part, regardless of the laws and regulations relating to the property of the authors production is a forgery and any forgery is an offense. Offenders will be prosecuted under the same law in the export and import of counterfeit work.

8.2 It is also an offense to reproduce and distribute by any means whatsoever, of intellectual work in violation of the rights of the author, as defined and regulated by law. It is an offense to violate of any of the rights of the author of the software.
Caution! Any use made without the consent of the author therefore constitute an infringement and will be subject to prosecution.

8.3 The company KSWC CO, LTD., And its guardians cannot be held liable for breach of Thai and international laws protecting intellectual property, for work, modifications, achievements made from any element of all kinds provided by the customer, such as texts, photographs, logos, images, graphics, he would not have exclusive ownership
